Marriage / De Facto Transfers

When adding a spouse to your property title in Western Australia, the process involves several important steps:

1. Prepare the Documentation: First, you need to complete a Transfer of Land form, indicating that you wish to add your spouse as a joint owner of the property. This form is lodged with Landgate, Western Australia’s land information authority.
2. Marriage or De Facto Relationship Verification: If you’re adding your spouse under a de facto relationship, you may need to provide additional documentation proving the relationship. This could include a statutory declaration or other supporting documents.
3. Stamp Duty Considerations: Adding a spouse to the title is typically exempt from stamp duty if the property is being transferred to a spouse or de facto partner, and the property will be used as your primary residence. However, you must submit the appropriate exemption forms along with the transfer documents.
4. Lodgement with Landgate: Once all documents are completed, they are lodged with Landgate, along with the required fees. Landgate will then update the property title to reflect the new ownership arrangement.

This process legally recognizes your spouse as a co-owner of the property, ensuring that their name is included on the Certificate of Title​

Separation or Divorce

When going through a separation or divorce in Western Australia, one of the key tasks is removing your ex-spouse’s name from the property title. This process typically involves the following steps:

1. Consent Orders or Binding Financial Agreement: First, you need to ensure that the property settlement is formalized either through Consent Orders from the Family Court or a Binding Financial Agreement. These documents outline how the property is to be divided and are necessary to proceed with the transfer without incurring additional stamp duty.
2. Transfer of Title: Once the agreement is in place, you can proceed with transferring the title. This involves lodging a transfer form with Landgate, Western Australia’s land information authority. You will need to submit the transfer form along with a copy of the Consent Orders or Binding Financial Agreement.
3. Lodgement: The completed transfer documents, along with any required fees, are lodged with Landgate to officially remove your ex-spouse’s name from the title.
