How do I update my title if a registered proprietor has passed away ?
In Western Australia, when dealing with a deceased estate, you might need to lodge either a Survivorship Application or a Transmission Application to update the property’s Certificate of Title.
- Survivorship Application: This is used when a property was owned jointly (as joint tenants). When one joint owner passes away, the surviving owner needs to apply to have the deceased’s name removed from the title, so the property is fully in the surviving owner’s name. This application requires the submission of the death certificate and sometimes a statutory declaration.
- Transmission Application: This is necessary when the property was owned solely by the deceased or as tenants in common (where each owner has a distinct share). The executor or administrator of the estate needs to lodge this application to transfer the property into their name so they can then manage it according to the Will, or if there’s no Will, according to the law. This process involves providing a Grant of Probate or Letters of Administration.
Both applications are important steps to ensure that the property is correctly transferred and that the legal ownership is properly recorded, allowing the executor or surviving owner to proceed with managing or disposing of the property​.
